Privacy Policy

Your privacy is of the utmost importance at KURU, and we adhere to a high standard of information security.

KURU considers customer privacy of utmost importance. The purpose of this Privacy Policy is to describe the kinds of information that we may gather about you; how we may use that information; how we protect it; when we may disclose it; and the choices you have regarding your information.

By visiting kurufootwear.com  (“Site”), you are consenting to the practices described in the current version of this Privacy Policy. If you have visited the Site previously, please review the Privacy Policy again to be sure you are familiar with its present terms.

If you have any questions or concerns about the privacy or security of your information, or to lodge a complaint regarding these policies and practices relating to the handling of personal information, you may contact KURU’s designated privacy officer at privacy@kurufootwear.com.

Personal Information We Collect

We may collect your personally identifiable information, such as your name, shipping address, billing address, email address, phone number and credit card information, in the course of processing your order, or when we otherwise communicate with you. For example, through order forms on our Site and through signups for our mailing list, we collect personally identifiable information necessary for shipping products that you purchase. We also may collect your financial information (like your credit card number and billing address) and your contact information (like your email address, phone number and shipping address). We may also collect your Internet Protocol ("IP") address, which is the number automatically assigned to your computer whenever you access the Internet. This number does not identify your name, email address, or other personal information. We use your IP address to help diagnose problems with our server and to administer our Site.

Non-Personal Information We Collect

We may automatically collect non-personally identifiable information from you when you visit our Site.

We may also collect non-personally identifiable information through the use of cookies. A cookie is an alphanumeric file that a Web site puts on your hard drive so that it can remember something about you while you are using the Site or when you return to the Site. Cookies make it easier for you to use our Site. We use a cookie in order to retain the contents in your shopping cart while you are visiting other areas on our Site. When you are done, the products in your cart are still there for you to buy. We may also use cookies to gather certain aggregate usage information about the numbers and frequency of visitors to our Site and individual pages of our Site. This data helps us improve the appearance and usability of the Site.

KURU, its advertisers and ad servers may also use cookies, as well as files called "Web beacons" or "clear gifs" to determine on an anonymous basis which advertisements and promotions our Site users have seen and how users responded to them.

Under the California Consumer Privacy Act, IP address is a personally identifiable piece of information.

Information From Other Sources

Information that you give us may be combined with other personally identifiable information (such as order history and demographic information) from third-party sources to make our marketing efforts more efficient. Examples of other information we receive from third-party sources include updated delivery and address information, which we use to correct our records and deliver your next purchase or marketing materials more easily.

Uses of Your Information

Financial information that is collected is used to bill you for products that you request. Contact information from the order form is used to send orders and information about KURU to you.

If you register for email or if you provide your email address to us, we will send you emails. These emails will inform you of our launch of new products, of special sales, of promotional offers from our partners, of environmental issues we think are important, and of potential employment opportunities with KURU that you may find of interest, and of other events taking place in our stores near you. If you currently receive our emails and do not wish to continue receiving them, please see the "How to remove your name from our mailing, sharing or email list" section below.

We use your shipping address to ship your products to you and we may send marketing mailings to you. We use your billing address, if different than your shipping address, to verify your billing information. We never share our customer names or addresses, e-mail addresses or other personally identifiable information, other than to the extent described in the “Disclosures of Your Information” section below. If you do not wish to receive mailings from us, please see the "How to remove your name from our mailing, sharing or email list" section below.

Disclosures of Your Information

We do not disclose your personal information to other companies, persons or agencies, except for the purposes described below:

Service Providers: We employ other companies and individuals to perform certain services and functions on our behalf. Examples may include operating and maintaining our Site, taking orders, fulfilling orders, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing consultation and assistance, distributing customer surveys, processing credit card payments, and providing customer service. These companies have access to personal information needed to perform their services or functions, and may use it for their own marketing/commercial purposes.

For Your Protection and Ours: We may release personally identifiable information when we believe it is appropriate to comply with applicable law regulation, legal process, or governmental request; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of KURU, our customers, our employees or others.

Business Transfers: As we continue to develop our business, we might sell or buy subsidiaries or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy (unless, of course, the customer consents otherwise). Also, in the unlikely event that KURU or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

Sharing: We may share your name and postal address with other reputable companies so they may send you catalogs about products of potential interest. We do not share credit card information with these third parties. If you prefer that we not share your name and postal address with other companies, please see "How to remove your name from our mailing, sharing or email list" section below.

With Your Consent: Other than as set out above, you will receive notice when information about you might go to third parties, and you will have the opportunity to choose not to share the information.

How We Use Cookies

A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We also use cookies to collect information about abandoned shopping carts. Once the cart is considered abandoned, an email or SMS message will be sent as a reminder if you have signed up to receive these notices.

Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies. Dispute Resolution
General

In the interest of resolving disputes between you and KURU in the most expedient and cost-effective manner, you and KURU agree that any dispute arising out of or in any way related to these messaging terms and conditions ("Messaging Terms") or your receipt of text messages from KURU or its service providers will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, which may allow for more limited discovery than in court and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or in any way related to these Messaging Terms, or your receipt of text messages from KURU or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory and regardless of when a claim arises. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MESSAGING TERMS, YOU AND KURU ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY THE FEDERAL ARBITRATION ACT.

Exceptions

Notwithstanding subsection 'General' above, nothing in these Messaging Terms will be deemed to waive, preclude, or otherwise limit the right of you or KURU to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; or (iv) file suit in a court of law to address an intellectual property infringement claim.

Arbitrator

Any arbitration between you and KURU will be governed by the Federal Arbitration Act and the Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Messaging Terms, and will be administered by the AAA. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting KURU. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

Notice; Process

If you or KURU intends to seek arbitration, then the party seeking arbitration must first send a written notice of the dispute to the other party by U.S. Mail ("Notice"). KURU address for Notice is: 4416 S Century Drive, Salt Lake City, UT 84123. Attn: Chief Executive Officer. The Notice must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought ("Demand"). You and KURU will make good faith efforts to resolve the claim directly, but if you and KURU do not reach an agreement to do so within 30 days after the Notice is received, you or KURU may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or KURU must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any.

Fees

If you commence arbitration in accordance with these Messaging Terms, KURU will reimburse you for your payment of the filing fee, unless your claim is for more than $15,000 or as set forth below, in which case the payment of any fees will be decided by the AAA Rules. If the claim is for $15,000 or less, you may choose whether the arbitration will be conducted: (i) solely on the basis of documents submitted to the arbitrator; (ii) through a non-appearance based telephone hearing; or (iii) by an in-person hearing as established by the AAA Rules. If the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In that case, you agree to reimburse KURU for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. You and KURU agree that such written decision, and information exchanged during arbitration, will be kept confidential except to the extent necessary to enforce or permit limited judicial review of the award. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from you or KURU made within 14 days of the arbitrator's ruling on the merits.

No Class Actions

YOU AND KURU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and KURU agree otherwise in a signed writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Modifications to this Arbitration Provision

Notwithstanding anything to the contrary in these Messaging Terms, if KURU makes any future change to this arbitration provision, other than a change to KURU address for Notice, you may reject the change by sending us written notice within 30 days of the change to KURU address for Notice, in which case this arbitration provision, as in effect immediately prior to the changes you rejected, will continue to govern any disputes between you and KURU.

Enforceability

If an arbitrator decides that applicable law precludes enforcement of any of the limitations of subsection 'Modifications to this Arbitration Provision' above (addressing class, representative and consolidated proceedings) as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and brought in court. If any other provision of these Messaging Terms is found to be unenforceable, the applicable provision shall be deemed stricken and the remainder of these Messaging Terms shall remain in full force and effect.

Intellectual Property

KURU does not solicit or accept product ideas, innovations, suggestions, technology concepts, designs or anything similar (collectively “Intellectual Property”) through this Site. Please do not send any Intellectual Property, or other product innovations and ideas to KURU through this Site. Should you choose to send any such Intellectual Property, in so doing, you grant to KURU an irrevocable, in perpetuity, royalty-free license to use the Intellectual Property. In addition, you agree to hold KURU, its affiliates and assigns harmless from using the Intellectual Property and agree to not take any legal action against KURU for said use of Intellectual Property. KURU is under no obligation to notify you of use of the submitted Intellectual Property. You also acknowledge and accept that there is a high likelihood that KURU is developing, or intends to develop product that uses Intellectual Property that is very similar, or exactly the same, as what is submitted. You also agree that this clause in this Terms of Use Agreement supersede all other legal agreements, even if the Intellectual Property sent has a legal agreement attached. This clause can only be modified via a separate, signed agreement by both parties.
